These Terms of Service (the "Terms") form a binding agreement between you and Monycompany Inc. ("Mony," "we," "us," or "our"). By texting Mony, creating an account, or using usemony.com (together, the "Service"), you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you don't agree, don't use the Service.
"Connected App" means a third-party service you authorize Mony to access, such as Spotify or Google Calendar. "Content" means messages, text, or other material sent to or generated by Mony. "You" means the individual using the Service under these Terms.
You must be at least 13 years old to use Mony. If you are under 18, you must have your parent or legal guardian's permission to use the Service and to agree to these Terms, including the arbitration provision in Section 18. By using Mony, you represent that you meet these requirements and have the legal capacity to enter into this agreement.
To use Mony, you provide a phone number, which we verify with a one-time passcode sent via SMS. You're responsible for keeping your device and phone number secure and for all activity that occurs through your account. Notify us immediately if you suspect unauthorized use.
Subject to your compliance with these Terms, Mony grants you a limited, personal, non-exclusive, non-transferable, and revocable license to use the Service for your own personal, non-commercial use. All rights not expressly granted are reserved.
By providing your phone number and messaging Mony, you consent to receive text messages from Mony, including account verification codes and responses to your requests, sent via automated technology. Message frequency varies based on your use of the Service. Message and data rates from your wireless carrier may apply. Carriers are not liable for delayed or undelivered messages. You may opt out of non-essential messages at any time by replying STOP, and can get help by replying HELP. Opting out of all messages, including OTP verification, will prevent you from using the Service.
You may choose to connect Connected Apps to Mony, such as Spotify, Google Calendar, Google Drive, Notion, Gmail, Ticketmaster, Eventbrite, Yelp, OpenTable, Apple Maps, Apple Music, or Perplexity. When you do, you authorize Mony to access and act on the data covered by the permissions you grant, and you represent that you have the right to grant Mony that access under your agreement with the relevant provider. You can disconnect a Connected App at any time. Mony is not responsible for the availability, accuracy, security, or practices of any Connected App, which remains governed by that provider's own terms.
You retain ownership of the messages you send to Mony. You grant Mony a worldwide, non-exclusive, royalty-free license to use, process, and store that content solely to operate, maintain, and improve the Service. If you send us feedback, suggestions, or ideas about the Service, you grant us an unrestricted, royalty-free, perpetual license to use them for any purpose without any obligation to you.

Mony is currently offered free of charge. We reserve the right to introduce paid features, subscriptions, or usage limits in the future, in which case we will provide notice and obtain any consent required by law before charging you.
Mony and its underlying technology, content, features, and branding are owned by Monycompany Inc. or its licensors and protected by intellectual property laws. These Terms don't grant you any rights to our trademarks, logos, or brand assets beyond what's needed to use the Service as intended.
If you believe content available through the Service infringes your copyright, send a notice to support@usemony.com including: a description of the copyrighted work, the material you claim is infringing and its location, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement made under penalty of perjury that the notice is accurate and that you are the copyright owner or authorized to act on their behalf. We will respond in accordance with the Digital Millennium Copyright Act.
The Service integrates with Connected Apps and other third-party providers we don't control. We make no warranties about those services and are not liable for their acts, omissions, availability, or content.
You may stop using Mony and request deletion of your account at any time by contacting us. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you've violated these Terms or for any other reason at our discretion. Sections that by their nature should survive termination (including Sections 11, 15-18, and 21) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DON'T GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, TIMELY, OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, MONY COMPANY INC. AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) 100 USD. SOME JURISDICTIONS DON'T ALLOW THESE LIMITATIONS, SO SOME OF THEM MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless Monycompany Inc. and its officers, employees, and service providers from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your Content, or your violation of these Terms.
Please read this section carefully. It affects your legal rights and requires most disputes to be resolved through individual binding arbitration rather than in court.
Agreement to arbitrate. You and Mony agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court.
Class action waiver. You and Mony agree that any arbitration or proceeding will be conducted only on an individual basis and not as a class, collective, or representative action, and the arbitrator may not consolidate more than one person's claims.
Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@usemony.com with your name and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other part of these Terms.
Exceptions. Either party may bring a claim for injunctive relief related to intellectual property infringement or unauthorized access to the Service in court without first engaging in arbitration.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. For any dispute not subject to arbitration under Section 18, you and Mony agree to the exclusive jurisdiction of the state and federal courts located in Delaware.
You may not use or export the Service in violation of U.S. export laws and regulations, and you represent that you are not located in, or a resident of, any country subject to U.S. embargo, and that you are not on any U.S. government list of prohibited or restricted parties.
Under California Civil Code Section 1789.3, California users are entitled to know that complaints may be directed to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and Mony regarding the Service, superseding any prior agreements.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
Notices. We may provide notices to you via the Service, text message, or the contact information on your account.
We may update these Terms from time to time. We'll update the "Last updated" date above, and where changes are material, we'll notify you through the product or another reasonable means. Continued use of Mony after changes take effect means you accept the updated Terms.
